Our Vision

1. Purchase of goods on Layby

a. All items sold in store are available to be purchased on Layby except the following:

1. 1. Promotional Items
   2. Items specifically excluded by JFBS.
   3. Laybys may be excluded from certain promotions, which may include but are not limited to one-day deals, Black Friday and new store opening deals as well as specific offers where limited quantities apply.

b. The Layby sale is valid for ninety (90) days from the date the sale is generated.
c. The pricing of all items on Layby are fixed for the duration of the Layby.
d. Availability of goods are guaranteed only while stocks last.
e. Any amendments to goods on Layby will be made at current prices.

f. You understand and agree that (i) the purchase price of the Goods includes tax at the current rate of tax; and (ii) if, at any time before you pay the full purchase price of the Goods, the tax rate is changed in relation to the supply of the Goods, we will be entitled to recover the tax increase from you prior to release of the Goods.

g. In order to purchase goods from JFBS on Layby you will need to:

1. 1. Be aged 18 years or older
   2. Pay a minimum deposit of 10%
   3. Have the legally required capacity to enter into, and be bound by these terms and conditions and;
   4. Furnish JFBS with any other information that we may require in order to process your lay-by transaction.

2. Payment of the purchase price

1. 1. The balance of the purchase price must be paid in instalments over the term of the Layby.
   2. You may pay the balance by way of any payment method accepted by the store.
   3. You must pay a minimum of 1 instalment each month. You may of course decide to pay more frequently if you wish.
   4. If you would like to know the balance owing on your lay-by, please visit the store and request this. You will need to provide us with proof of your identity in form of your ID or driver’s license as well as the original till slip before we can provide you with the balance.

3. Termination

1. 1. You may terminate the lay-by at any time. You will need to do this in person at the store and provide us with proof of your identity in form of your ID or driver’s license. You may also need to complete certain standard-form documentation when terminating the lay-by.
   2. If you terminate this agreement before you have paid for the goods in full or if you fail to complete the payment for the goods within the prescribed lay-by period, then:

1. 1. 1. 1. 1. We may charge you a termination penalty (10%) in terms of the Consumer Protection Act and the regulations thereto; and
            2. After deducting the termination penalty from any amounts, you have paid to us, we will refund the balance remaining (if any) to you.
            3. No cash refunds will be granted in store, an EFT will be processed. The following documents will have to be provided:
               1. ID Document
               2. JFBS Refund Form duly completed and authorised.
               3. Proof of banking details
               4. Original till slip.

4. Personal and confidential information

1. In this agreement, personal information means any and all information you give us or that we already hold about you, including your name, identity number, contact details and all information concerning the lay-by transaction.
2. We may disclose your personal information to our employees and contractors; to any organisation which underwrites or supports any of our goods; to any person to whom we transfer any of our rights or obligations under this agreement and we may furthermore disclose, transfer, license or otherwise authorise the use of any of your personal information to the extent lawful.
3. You hereby consent to receive approaches and/or communications from us and from our marketing service providers (whether via phone, SMS e-mail or otherwise) for the purposes of marketing (including direct marketing) and the conduct of market research.

5. General

1. Each paragraph, clause, term, and provision of this agreement is severable and if for any reason any part of this agreement is held to be invalid, contrary to, or in conflict with any applicable present or future law or regulation (including the Consumer Protection Act and the regulations thereto) or in terms of a final, binding judgment issued by any Court or arbitrator such paragraph, clause, term and/or provision shall, to that extent, be deemed not to form part of this agreement and the severing of such paragraph, clause, term and/or provision shall not impair the operation of, or have any other effect upon, such other portions of this agreement as may remain otherwise intelligible, which shall continue to be given full force and effect and bind us both.
2. You must collect the Goods within fourteen (14) days of payment of the full purchase price.
3. Goods may only be collected from the original store of purchase and upon production of a copy of the layby agreement and valid identity document of the Purchaser.
4. If your contact details or address change, you must notify the Seller within seven (7) days of such change.
5. We will require proof of the Purchaser’s identity and the original till slip when the Goods are collected.
6. No failure or delay by a party to enforce or exercise a right in terms hereof will thereby be deemed to be a waiver or abandonment thereof;
7. These terms and conditions may be amended from time to time, and in such a case the amended terms and conditions shall apply to you with immediate effect;
8. You confirm that the terms and conditions, the meaning and consequences of this agreement have been presented and explained to you in a language that you understand. You also confirm that the risks relating to the agreement, as well as your rights and obligations, have also been explained to you;
9. Please note, the item bought on layby is bought at the agreed price, and no correspondence will be entered into should that price change during the course of the layby agreement.
